The Order proposes to extinguish public rights over part of the recorded width of Public Footpath No. 11. The affected part comprises a longitudinal strip of land 2 metres in width. Following the extinguishment, a longitudinal strip of 3 metres in width will remain as public footpath along the existing alignment.
The proposed Order does not extinguish the route of Footpath No. 11. The route will remain open, continuous and available for public use along the same alignment between Kybes Lane and Longwater Avenue. The Council considers the remaining 3-metre-wide path is sufficient to accommodate pedestrians and maintain access to the wider walking network, including links to Green Park Station. The proposal will not alter the alignment of the footpath, remove any connections, or affect access to land served by the route.
As a consequence of the extinguishment, the Definitive Map and Statement will be updated to accurately reflect the remaining extent of the public right of way.
The Council’s full Statement of Reasons is available as an attachment for further review. Having considered its statutory duties, including the requirements of the Rights of Way Improvement Plan, the Council is satisfied that the proposal will maintain accessibility and connectivity while removing public rights over land that is no longer needed for highway purposes.
